As required by the Municipal Elections Act, 1996, municipalities must establish a compliance audit committee before October 1 in the year of a municipal election. The report provides details regarding the duties, membership, and recruitment process for the Committee. Council is asked to approve an amendment to City of Kingston By-Law Number 2023-204 to authorize the Committee's establishment.
By-Law to Amend City of Kingston By-Law Number 2023-204
Report Number 26-115 presents a by-law amendment to City of Kingston By-Law Number 2023-204 that revises Schedule 15 to establish the Election Compliance Audit Committee for the 2026-2030 term. The amendment specifies that the three-member committee must oversee municipal election campaign finance compliance by reviewing audit applications, considering clerk reports on contribution violations, and deciding whether to pursue legal proceedings against candidates or contributors who appear to have contravened the Municipal Elections Act, 1996. Committee members will receive $240 per meeting and must meet strict eligibility requirements, including being independent of city government, candidates, and registered third parties.
Report 26-140
This report seeks Council approval to enter into Municipal Capital Facility Agreements (MCFAs) with Kingston Community Health Centres (KCHC) and Home Base Housing (HBH) for the operation of 315 Queen Mary Road, a city-owned property purchased in 2024. The building is being renovated to house a medical clinic operated by KCHC and a transitional supportive housing program operated by HBH. The MCFAs are necessary to ensure long-term financial viability of both facilities. The report recommends Council declare the facilities as municipal capital facilities for public use, approve separate leases with both organizations that include municipal capital facility provisions, and pass by-laws exempting the occupied premises from municipal and education taxation upon lease execution.
Report 26-156
This report updates Council on the Agreement of Purchase and Sale for the Winnett Fraser Farm at 2000 Front Road (Lemoine Point Farm) and requests approval for closing costs. The City's 30-day due diligence period expired on April 20, 2026, and the City waived its condition, with closing scheduled for late May 2026. The report outlines estimated closing costs of up to $325,000, with a requested budget amendment of $290,000 to be funded through debt financing, with debt payments from the Municipal Capital Reserve Fund. The remaining $35,000 will be covered by the existing Business, Real Estate & Environment budget. Following closing, staff will conduct further review to identify immediate capital requirements and ongoing operating costs for property maintenance and security. The acquisition aligns with the Council Strategic Plan goal to maintain the City's natural heritage and environmental assets.
